Terms of Service

These terms govern your use of NewLaunch MY (newlaunch.com.my), a self-serve advertising platform for Malaysian real estate negotiators (RENs). By creating an account or using the service, you agree to these terms.
1. Eligibility
You must be a licensed Real Estate Negotiator (REN) registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers (BOVAEP / LPPEH) of Malaysia, or be acting under the authority of one. You must be at least 18 years old and able to form a legally binding contract.
We reserve the right to verify your REN status and to suspend or terminate accounts where verification fails or where false information is provided.
2. Account approval
Sign-ups are reviewed manually. We may approve or reject any application at our discretion. Rejected applicants may re-apply with corrected information. Approval typically takes 1–2 business days.
3. Subscription & payment
- Paid plans are billed monthly via Stripe in Malaysian Ringgit (RM)
- Subscriptions auto-renew until cancelled
- You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period
- No refunds for partial months
- Plan limits (number of landing pages, active campaigns, custom domains) are enforced in the dashboard
Ad spend is separate. Meta and Google bill you directly for ads run through your connected accounts. NewLaunch MY never holds funds for ad spend or takes a cut of ad budgets.
4. Your content & APDL compliance
You retain ownership of all content you upload (photos, copy, branding, REN number, agency name). You grant NewLaunch MY a non-exclusive licence to host, display, and distribute that content as part of the service.
You are solely responsible for ensuring your landing pages and ads comply with the APDL (Advertising Permit & Developer Licence) requirements, BOVAEP code of conduct, the Malaysian PDPA 2010, and all platform policies (Meta, Google, TikTok). We provide compliance tools but cannot guarantee approval by ad platforms.
5. Acceptable use
You agree not to use NewLaunch MY to:
- Misrepresent properties, prices, or your professional credentials
- Run advertising for properties you are not authorised to market
- Spam, phish, or otherwise harm buyers
- Violate any Malaysian or applicable foreign law
- Reverse-engineer, scrape, or attempt to extract platform data outside your own account
- Resell access to NewLaunch MY or use it on behalf of unauthorised third parties
Violations may result in immediate suspension and forfeiture of any prepaid balance.
6. Lead ownership
Buyer enquiries collected through your landing pages belong to you. We act as a processor delivering them. If you cancel your account, you can export your leads from the dashboard before deletion.
7. Service availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, deploy updates, or take services offline temporarily. We are not liable for losses arising from downtime, missed leads, or third-party platform outages (Meta, Google, WhatsApp, Stripe, Supabase, Vercel).
8. Termination
You may close your account at any time from settings. We may suspend or terminate accounts for breach of these terms, non-payment, or to comply with legal requirements. On termination, your published landing pages remain live until the end of your billing period, after which they are taken down.
9. Disclaimer & limitation of liability
NewLaunch MY is provided “as is”. To the maximum extent permitted by Malaysian law, our total liability for any claim arising from your use of the service is limited to the amount you paid us in the previous 12 months. We are not liable for indirect, consequential, or lost-profit damages.
10. Changes to these terms
We may update these terms. Material changes will be announced by email and posted on this page with a new “last updated” date. Continued use after a change constitutes acceptance.
11. Governing law
These terms are governed by the laws of Malaysia. Any dispute arising from your use of NewLaunch MY shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur.
